Louisiana Affidavit Of Heirship

louisiana affidavit of heirshipIf someone dies, and that person had a vehicle titled in their name, you will need a Louisiana Affidavit Of Heirship form to fill out. Let’s give an example:

John’s wife Sara passes away. They both owned a car titled in both of their names. Sara had no will, and there were no other heirs. Now John wants to sell the vehicle, but how can he do that since the title is also in Sara’s name? John needs to download this free form and fill it out: louisiana affidavit of heirship

Now John will fill the form out, sign it in front of a notary, attach a copy of the death certificate, attach the title, and send it to the OMV with his payment of the fees. John will then receive a new title that is only in his name.

Certified Notary Signing Agent

notary investigatorI have been resisting this for a long time, but for some reason I went ahead and paid to become a Certified Notary Signing Agent with the National Notary Association. What does that mean? It means that someone made a chunk of money from me so that I could be “trained” to handle loan closings,pass a simple test so that I can brag about my specialty, and even go through a “rigorous” background check.

So why did I resist for so long? As you may detect from my tone, it’s really silly. A fifth grader could pass the test. In my opinion, I am no more, or less, qualified to handle loan closings now than I was before. For example, one question in the test was something like, “When arriving at a signing should you park in the borrower’s driveway or in front of their house?” The reasoning behind parking in front of the house is so that you don’t leave oil stains on their driveway. Sorry, but that is beyond pointless, at least to me.

The background check is also a joke. I won’t go into details, but if you knew how extensive my previous background checks were you would get it. Having to get screened by an “internet investigative team” is just bad. Then again, some people seem to think that it matters.

Now that I have insulted the importance, I can at least say that I am a Certified Notary Signing Agent that has undergone a background screening from the NNA! Yay?

Mobile Notary Public Questions

As a mobile notary public in Baton Rouge, Louisiana I get asked a lot of questions. If your questions are not answered here, or you need more information, call me 24/7 at 225-907-5280.

Q: What is a mobile notary public?

A: A notary public can notarize your legal documents. In most cases, we simply witness the signing of legal documents. As a mobile notary, I also notarize your papers, and I come to you. A mobile notary can travel to you, no matter where you are.

Q: How much does a mobile notary cost?

A: A little more than a notary that you travel to visit, in most cases. You are paying to get your papers notarized, and you are paying for the notary to travel to you. With the cost of gas, the time involved, and the potential of traveling for nothing, you can understand why it would cost a bit more. I like to compare it to shopping for groceries yourself or paying for someone to bring the groceries to you. A mobile notary will save you a lot of hassle, but you will probably pay a bit more for the service.

Q: But how much does it really cost for a mobile notary to come to me?

A: I don’t like to give vague answers, but it really does depend. Before I, or any mobile notary, can tell you the cost, I need to know what you need to be notarized, whether you have the papers or need them drafted, where you need me to be, and even the time of day. The only way to get an accurate quote is to call the notary (225-907-5280).

Q: Can you notarize some papers for me if I don’t have an id?

A: No. As a notary, I am attesting to the fact that you signed the documents. I need to be able to identify the people that are signing,and they need to sign in front of me.

Q: Can a mobile notary help me at night or on the weekends?

A: Some can, and some can’t. As far as I know, I am literally the only mobile notary in the Baton Rouge area that really does work 24 hours a day, 7 days a week.

Q: Do I need a bill of sale?

A: If you are buying or selling a vehicle in Louisiana, I highly advise you to get a bill of sale that is signed by both parties in front of a notary. It can save you from a ton of headache in the future!

Q: Can you notarize a copy of a birth certificate?

A: I could, but it won’t do you any good in Louisiana.

Q: How far will a mobile notary public travel?

A: Some will only travel in their city, some will travel 100 miles. My normal travel area is East Baton Rouge Parish and all surrounding parishes. The longer the drive, the more my fee is. I hope you understand.

Q: Do I need to have witnesses?

A: It depends upon what you need to have notarized. In Louisiana, a vehicle or real property conveyance requires two witnesses.

Q: Can any notary help me with loan documents?

A: Yes, but some of us have been trained to deal with financial documents such as mortgages. I have been certified by the National Notary Association and have gone through a background check in order to work on loan signings.

Louisiana Antique License Plate

The requirements to get an antique license plate for your car or truck in Louisiana are:

  • The vehicle must be at least 25 years old.
  • It must be maintained in its original condition.
  • Fill out the application affidavit. If you belong to an antique car club you can skip the form and include a copy of your membership card.
  • Include a recent color photograph of your vehicle with the application.
  • Pay $36.50. You can get it personalized for $25 more.
  • Mail your application with the photo and money to the LA OMV.

Louisiana Temporary Custody Of A Child Form

use the louisiana provisional mandate to grant temporary custody of the childLet’s say that you want to grant custody of your child to your sister for a few weeks, but you don’t want to hire an attorney and get permission from the family court to transfer guardianship to your sister. What can you do? With the Louisiana Provisional Custody By Mandate form you are basically granting a power of attorney for your sister to act as the agent on your behalf in regards to your child, and to give temporary custody of the child. If this form is properly executed, your sister can enroll your child in school, take her to the doctor, etc. Your sister is practically the legal guardian of your child, without the burdens involved in transferring guardianship of a minor in Louisiana. This is an ideal form to use to grant temporary custody of a minor in Louisiana.

An important distinction in using the LA Provisional Custody instead of seeking an order from a family judge to transfer guardianship of the child is that this provisional custody is truly “provisional”. It will not last longer than a year, and it can be dated to last much shorter than a year. It’s supposed to be used to grant a temporary authority to act as the parent of your child.
